Most businesses come to a debt collector after the same sequence: polite reminders, a promise to pay, a part-payment, then silence. A professional debt collection agency changes the signal: not with threats, but with a documented process that visibly ends in court if ignored.
What does a debt collection agency do in Malaysia?
A debt collection agency works the pre-litigation layer of recovery: turning an ignored receivable into payment without a courtroom. In practice that means four jobs.
- Debtor intelligence. SSM, litigation and winding-up checks, and tracing debtors who have gone quiet — so you know whether a judgment would ever turn into cash.
- Structured demand. A professional letter of demand with a clear 7 to 14 day deadline, followed through on the day it expires.
- Negotiation and settlement. Payment plans secured by a signed acknowledgement of debt (which restarts the six-year limitation clock) and a default clause.
- Escalation management. Handing the file to solicitors, evidence assembled, the moment talking stops working.
What an agency cannot do is appear in court, give legal advice, or sign court process. That belongs to advocates and solicitors. CIRN & CO is not a law firm; litigation on our mandates is conducted through solicitors, so the file moves from demand to court without changing hands. The difference is set out fully in debt collection agency vs lawyer in Malaysia.
What a good debt collection agency does before it sends a single letter
The quality of a debt collector shows in the first conversation, not the first letter. A good agency will:
- Ask for your oldest invoice date. Under section 6 of the Limitation Act 1953, a contract debt must be sued on within six years of falling due. An agency that does not check this is not thinking about your file.
- Ask whether the debt is disputed. A genuine dispute changes the route, the fee and the timeline.
- Check the debtor before you spend. Trading status, existing judgments, charged assets: a collectable debtor and an empty shell need different strategies.
- Put the mandate in writing. Fee rate, the event that triggers the fee, disbursements, reporting, and — critically — a requirement that any discount or instalment plan needs your written approval.
- Tell you what happens if the debtor refuses. Who files, under whose name, and what it costs. A debtor who senses your collector cannot escalate has no reason to pay.

What does lawful debt collection look like in Malaysia?
Hiring a debt collector in Malaysia is legal. The legal risk sits in how the debt is collected. The Penal Code criminalises intimidation, extortion, wrongful restraint, trespass and mischief; the Communications and Multimedia Act 1998 covers menacing communications; defamation law covers public shaming. None of it has a debt-collection exception, and a creditor whose agent crosses the line shares the consequences.
| Lawful, professional collection | Outside the line | |
|---|---|---|
| Contact | Identifies itself and the creditor; written demand to the debtor at its registered or business address | Anonymous calls, calls at all hours, abusive language |
| Pressure | Clear deadlines and the real legal next step — suit, statutory demand, enforcement | Threats of violence, "field visits", intimidation |
| Third parties | Deals with the debtor, its officers and any guarantor | Pressuring family, employees or customers who owe nothing |
| Property | Seizure only by a court bailiff under a writ, after judgment | Taking goods or vehicles, forcing entry, camping at premises |
| Reputation | Confidential correspondence and court process | Paint, posted notices, social-media shaming |
| Record | Every step documented and copied to you | Methods the firm will not put in writing |
Bank Negara Malaysia's guidance on collection conduct binds agents acting for financial institutions, but it has become the practical benchmark for any collector. Our standard meets it: no harassment, no threats, no shaming, no improper contact with third parties. Unlawful pressure also backfires: it hands the debtor a counterclaim to bargain with. More in is hiring a debt collector legal in Malaysia.
How our debt collection process works
- Mandate. Send us the file. A senior partner reviews it within 24 hours with a candid view of recoverability. You sign a written mandate: contingency rate, disbursements, reporting and settlement authority — all agreed upfront.
- Letter of demand within 5 working days. We verify the debt pack, run the debtor checks, and issue a formal demand with a fixed deadline. For an undisputed company debt of RM 50,000 or more, the first instrument may instead be a statutory demand through solicitors.
- Negotiation and settlement. Most undisputed commercial debts pay or restructure here. Any instalment plan is documented with an acknowledgement of debt and a default clause, and nothing is agreed without your written approval.
- Legal action through solicitors, where needed. If the deadline passes in silence, the file escalates with your approval: a civil suit with summary judgment under Order 14 of the Rules of Court 2012, a section 466 statutory demand under the Companies Act 2016, bankruptcy against an individual debtor owing RM 100,000 or more (RM 150,000 from 2027), or CIPAA 2012 adjudication for construction payments.
- Enforcement. Garnishee orders against bank accounts, writs of seizure and sale, and judgment debtor summonses turn a judgment into money, chosen by where the debtor's assets are.
How much does a debt collection agency charge in Malaysia?
Commercial debt collection in Malaysia is mostly priced on success: a percentage of what is actually collected, commonly in the 10% to 30% range depending on the age, size, documentation and dispute risk of the debt. The alternatives are hourly legal fees, fixed fees per stage, or a hybrid.
| Fee model | What you pay | Your risk | Best for |
|---|---|---|---|
| CIRN & CO contingency | 0% upfront; fee as low as 10% of sums actually recovered | Low — no recovery, no fee | Undisputed commercial debts from RM 1,000 upwards |
| Typical commission agency | Commonly 10%–30% of sums recovered | Low on fees; check disbursement terms | Ordinary trade debts, aged ledgers |
| Hourly legal fees | Time billed at agreed rates, win or lose | High — payable even if nothing is collected | Genuinely disputed claims, large claims with a clean summary-judgment path |
| Fixed fee per stage | A set fee per letter, demand or filing | Medium — paid even if the stage produces nothing | Repeat, predictable demand-stage volume |
Two questions matter more than the rate. First, what event triggers the fee — cleared funds received, or merely a settlement or judgment obtained? Insist on the former. Second, who pays disbursements — court filing fees, service and bailiff costs, searches — and when. We agree both in writing before work starts. The economics are broken down in no win no fee debt collection in Malaysia and debt recovery costs compared.
How long does debt collection take?
| Stage | Realistic duration |
|---|---|
| Letter of demand and negotiation | 2–4 weeks; most undisputed B2B debts resolve in 30–90 days |
| Section 466 statutory demand (company, RM 50,000+) | 21-day statutory period; the track commonly resolves in 60–90 days |
| Civil suit to Order 14 summary judgment | Roughly 6–12 months |
| Fully contested trial | 12–24 months, plus enforcement |
| CIPAA adjudication (construction) | Commonly 3–5 months end to end |
The biggest delay in most files is not the court — it is the creditor waiting weeks between an expired deadline and the decision to escalate. What documents should I prepare for a debt collector?
The stronger the paper, the faster the recovery. Send what you have; gaps are normal.
- The agreement: signed contract, quotation accepted, purchase orders, or terms and conditions showing credit terms and any interest clause.
- Proof of performance: delivery orders, signed goods-received notes, job completion or progress certificates.
- The debt itself: invoices and a current statement of account showing payments received.
- Admissions: emails, WhatsApp messages or letters in which the debtor accepts the balance or promises to pay — these can restart limitation.
- Security: any personal guarantee from a director, post-dated cheques, or other security.
- Debtor details: exact registered name and SSM number, business address, and the people you dealt with.
When should debt collection become legal action?
Collection and litigation are layers of the same pipeline. Move to solicitors without delay when:
- The debt is genuinely disputed. You need advice on the merits before pressure is applied.
- The debt is approaching six years old. Only issuing proceedings stops the limitation clock; a letter does not.
- The debtor is a company owing RM 50,000 or more, undisputed. A statutory demand puts winding-up on the table 21 days after service — see winding up a company over RM 50,000.
- The debtor is an individual owing RM 100,000 or more. Bankruptcy under the Insolvency Act 1967 becomes available. The threshold is RM 100,000 today, rising to RM 150,000 from 2027 (announced in Budget 2027; applies once the Insolvency Act amendment takes effect) — see the bankruptcy threshold explained.
- Assets are being moved. Urgent court relief comes first; negotiation resumes once assets are secured.

Frequently asked questions
How much does a debt collection agency charge in Malaysia?
Most commercial collection in Malaysia is priced as a success fee on sums actually recovered, commonly in the 10% to 30% range depending on debt age, size, documentation and dispute risk. CIRN & CO charges 0% upfront and a contingency fee as low as 10%. Court and search disbursements should be agreed in writing.
Is it legal to use a debt collection agency in Malaysia?
Yes. A creditor may appoint a third party to pursue a lawful debt. What the law prohibits is the method: threats, intimidation, trespass, self-help seizure and public shaming are offences whoever commits them. A professional agency collects through documented demand, negotiation and, where needed, court process through solicitors.
Can a debt collection agency sue my debtor?
Not in its own right. Court proceedings in Malaysia are conducted by advocates and solicitors. A good agency works with solicitors so the same file escalates to a civil suit, a section 466 statutory demand or enforcement with your approval, without restarting from zero.
What is the smallest debt CIRN & CO will collect?
We accept commercial claims from RM 1,000. Smaller invoices are worth chasing professionally because the first letter of demand often resolves them, and on a contingency basis there is no upfront cost to try.
How quickly will the debtor hear from you?
A senior partner reviews your submission within 24 hours. Once the mandate is confirmed, the first action, usually a letter of demand, goes out within five working days.
